1. INTRODUCTION

Welcome to Spa Medica Aesthetic. These Terms of Service (“Terms”) govern your use of our website, online booking platform, communications, and any services (the “Services”) made available through Spa Medica Aesthetic, Inc. (“we,” “us,” or “our”). By accessing or using our website or Services, you agree to be bound by these Terms and all applicable laws and regulations.

These Terms apply to all visitors, clients, and users of the site. You must be at least 18 years old to use our Services. YOU AFFIRM THAT YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND ARE FULLY ABLE AND COMPETENT TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE TO THIS AGREEMENT, PLEASE DO NOT USE THE SERVICES AND EXIT NOW.
 

We may update these Terms from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.

2. SERVICES & MEDICAL DISCLAIMER

Spa Medica Aesthetic offers elective aesthetic and wellness treatments, including but not limited to cosmetic injections, IV therapy, B12 and weight-loss shots, laser and skin-enhancing treatments.

All services are provided by licensed healthcare professionals acting within the scope of their professional licensure. While these services may be medical in nature, the information provided on our website is for general informational purposes only and does not constitute medical advice.

Use of our site or Services does not create a doctor-patient relationship. You are encouraged to consult directly with your provider to determine if a treatment is appropriate for you.

We reserve the right to modify or discontinue any Services at any time, without notice.

 

3. ELIGIBILITY & CLIENT RESPONSIBILITY

By using our Services, you represent that you are at least 18 years of age and legally capable of entering into this agreement. You agree to provide accurate and current information during the booking or intake process and to update us if any of your information changes.

You understand that certain treatments may not be appropriate for all individuals and agree to complete any necessary consent forms, health disclosures, or pre-treatment assessments prior to receiving services. We reserve the right to refuse treatment if we determine, in our sole discretion, that a service is not suitable or safe for you.

4. APPOINTMENTS, CANCELLATIONS & LATE POLICY

To schedule a treatment, clients must use our online booking platform or contact us directly. A credit card may be required to secure your appointment.

We kindly request at least 24 hours’ notice for cancellations or rescheduling. Cancellations made within 24 hours of the appointment time may incur a cancellation fee. No-shows may result in a full service charge.

If you arrive late to your appointment, we will do our best to accommodate you within the remaining time. However, we may need to shorten or reschedule your service to respect the time of other clients.

5. PAYMENTS, DEPOSITS & REFUNDS

Spa Medica Aesthetic accepts major credit cards and other approved payment methods at the time of service or online. Some treatments may require a non-refundable deposit to confirm your booking.

All treatments are elective and therefore not eligible for insurance reimbursement. We do not accept health insurance.

Due to the nature of aesthetic services, all sales are final. No refunds will be issued for services rendered, even if the outcome does not meet personal expectations. We encourage clients to consult with our licensed professionals prior to treatment to determine the best approach.

6. MARKETING, COMMUNICATION & ADVERTISING DISCLOSURE

By booking an appointment, filling out a form, or submitting your contact information, you consent to receive transactional and marketing communications from Spa Medica Aesthetic via email, SMS, or online advertising platforms.

We may use non-identifiable, anonymous browsing data to improve our site experience and marketing performance. This may include showing general awareness ads (e.g., "Get Glowing Skin This Summer") through third-party platforms such as Meta and Google Ads.

We do not share or sell personal health information (PHI) unless we have your explicit written authorization. Any PHI collected during your intake or treatment process is handled in compliance with HIPAA and applicable California privacy laws. You may opt out of marketing communications at any time.

Mobile Terms of Service
The SPA MEDICA AESTHETIC mobile message service (the "Service") is operated by SPA MEDICA AESTHETIC (“SPA MEDICA AESTHETIC”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to SPA MEDICA AESTHETIC’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of SPA MEDICA AESTHETIC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with SPA MEDICA AESTHETIC. Your participation in this program is completely voluntary.We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18667889032 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other SPA MEDICA AESTHETIC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

8. DISCLAIMERS & LIMITATION OF LIABILITY

All treatments offered at Spa Medica Aesthetic are elective and cosmetic in nature. Outcomes may vary depending on individual skin types, lifestyle factors, and compliance with aftercare instructions. Results are not guaranteed.

You agree that Spa Medica Aesthetic, its owners, staff, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or misuse of our services, including but not limited to discomfort, side effects, or dissatisfaction with results.

By undergoing treatment, you understand and accept the potential risks involved. You must consult directly with a licensed professional before proceeding with any medical or aesthetic procedure.

9. DISPUTE RESOLUTION & GOVERNING LAW

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.

Any dispute, claim, or controversy arising from your use of the Site or Services shall first be addressed through good-faith efforts to resolve the issue informally. If a resolution cannot be reached, you agree that any formal legal action must be brought exclusively in the state or federal courts located in Los Angeles County, California.

You waive any objection to jurisdiction and venue in those courts. This clause does not limit your rights under applicable consumer protection laws.
