Terms of Service

1. Introduction

(a) This website (the “Site”) is owned and operated by SPA MEDICA AESTHETIC, INC. Use and access to the Site and related internet-based services, features, content, and functionality, including appointment booking services (the “Booking Service” and collectively with the Site, the “Services”), are subject to the following terms and conditions of use (the “Terms and Conditions” or “Agreement”) and all applicable laws and regulations. By accessing, viewing, or using the Services, you, on behalf of yourself and all of your authorized representatives (collectively, the “User,” “you” or “your”), agree to the Terms and Conditions. YOU AFFIRM THAT YOU ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AND ARE FULLY ABLE AND COMPETENT TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE TO THIS AGREEMENT, PLEASE DO NOT USE THE SERVICES AND EXIT NOW.

(b) SPA MEDICA AESTHETIC reserves the right to supplement or make changes to the Terms and Conditions without advance notice. Users are responsible for reviewing the Terms and Conditions periodically. Any changes will be effective immediately upon posting on the Site, with the “Last Updated” date displayed at the top of the revised policy.

(c) While SPA MEDICA AESTHETIC strives for accuracy in describing professional services provided by licensed professionals, SPA MEDICA AESTHETIC does not warrant that all information on the Site is accurate, complete, reliable, current, or error-free.

2. Services

(a) SPA MEDICA AESTHETIC’s Services enable Users to request and book certain professional services provided by licensed medical or aesthetic professionals at SPA MEDICA AESTHETIC. SPA MEDICA AESTHETIC DOES NOT PROVIDE MEDICAL SERVICES OR MEDICAL ADVICE. ONLY LICENSED HEALTHCARE PROVIDERS MAY PROVIDE MEDICAL SERVICES OR ADVICE. Use of the Services does not create a doctor-patient relationship. Users are solely responsible for their decision to obtain treatment from a medical professional.

(b) SPA MEDICA AESTHETIC shall provide the Services to Users solely for their intended purposes, subject to compliance with these Terms and Conditions.

(c) Users must comply with any additional terms applicable to third-party software integrated into the Services.

 

3. Proprietary Rights

(a) Users acknowledge SPA MEDICA AESTHETIC’s proprietary rights in the Services, technology, and content (“Content”). SPA MEDICA AESTHETIC retains all rights in the Services and Content, subject to the licenses granted herein.

(b) Any feedback provided by Users may be used by SPA MEDICA AESTHETIC for commercial or non-commercial purposes, without restriction.

(c) Users are granted a limited, non-exclusive right to access and use SPA MEDICA’s technology solely for the intended purpose.

(d) All trademarks, service marks, and logos displayed on the Site are the property of SPA MEDICA AESTHETIC or their respective owners and may not be used without permission.

4. User Information; Data Retention and Collection

(a) Users grant SPA MEDICA AESTHETIC a non-exclusive license to use User Information solely to provide the Services.

(b) SPA MEDICA AESTHETIC may collect and analyze non-personally identifiable data resulting from User’s use of the Services (“Blind Data”) for lawful business purposes.

(c) SPA MEDICA AESTHETIC has security measures in place to protect user data. The Privacy Policy is incorporated into this Agreement.

(d) SPA MEDICA AESTHETIC will not alter User information unless necessary to maintain accuracy.

 

5. User Restrictions

Users agree not to misuse the Services, including but not limited to unauthorized copying, reverse engineering, or uploading malicious software.

 

6. Booking Service Payments, Refunds, and Credits

Users agree to pay fees for booked services. Cancellations require at least 12-hour notice, otherwise, a cancellation fee may apply. Payments are processed at the time of service. SPA MEDICA AESTHETIC does not accept health insurance for services.

 

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. SPA MEDICA MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO THE SERVICES’ FITNESS, ACCURACY, OR MERCHANTABILITY. USERS ASSUME ALL RESPONSIBILITY FOR THEIR USE OF THE SERVICES.

 

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPA MEDICA SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF THE SERVICES.

 

9. Indemnification

Users agree to indemnify SPA MEDICA AESTHETIC against all claims arising from their use of the Services or breach of these Terms and Conditions.

 

10. Term; Termination

(a) This Agreement commences upon User’s use of the Services and continues until terminated. SPA MEDICA AESTHETIC may terminate this Agreement immediately for breach. Users may terminate by ceasing to use the Services.

(b) Upon termination, User’s right to use the Services ceases, but certain provisions survive termination.

(c) In the event of a material breach, SPA MEDICA AESTHETIC may seek injunctive relief.

 

11. Confidential Information

(a) “Confidential Information” includes the Services and related information.

(b) Users agree to hold Confidential Information in confidence and use it only for the intended purpose.

(c) Users may disclose Confidential Information only as required by law, with prior notice to SPA MEDICA AESTHETIC.
